These Terms of Service ("Terms") are a legal agreement between you and Flying V Studios ("Flying V," "we," "us," or "our") governing your access to and use of Marauder's Sea, its website, game servers, accounts, memberships, community features, and related services (collectively, the "Service").
By creating an account, purchasing a membership, clicking an acceptance button, or accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
You may use the Service only if you can legally enter into these Terms. If you have not reached the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms on your behalf and is responsible for your use of the Service.
Children under 13 may not create an account or submit personal information unless Flying V has expressly enabled an age-appropriate experience and obtained any parental consent required by law. A parent or guardian who believes a child provided personal information without authorization should contact us immediately.
You must provide accurate information, keep your login credentials confidential, and promptly notify us of suspected unauthorized access. You are responsible for activity occurring through your account unless prohibited by law. Accounts may not be sold, transferred, shared commercially, or used to impersonate another person.
We may require account verification, limit duplicate accounts, or refuse usernames that are deceptive, infringing, abusive, or disruptive.
Some Service features may require a paid membership. Prices, billing intervals, included features, and renewal terms will be displayed before purchase. Taxes may be added where required.
If you purchase an automatically renewing membership, you authorize the disclosed recurring charges until cancellation. Automatic-renewal terms must be clearly presented at checkout. You may cancel using the same general method by which you enrolled, through your account settings where available, or by contacting us. Cancellation stops future renewals but does not ordinarily reverse charges already incurred.
Refunds are provided only as stated at checkout, in an applicable refund policy, or when required by law. We may change future membership prices or features after reasonable advance notice. A price change will not apply retroactively to a completed billing period.
Chargebacks filed without first attempting to resolve a legitimate billing problem may result in account restriction, but nothing in these Terms limits rights provided by your payment provider or applicable law.
Subject to these Terms, Flying V grants you a limited, personal, nonexclusive, nontransferable, revocable permission to access and play the Service for lawful entertainment purposes. This permission does not transfer ownership of Flying V branding, original artwork, music, written content, databases, or other proprietary material.
Open-source software included in the Service is governed by its applicable open-source licenses. If these Terms conflict with an applicable open-source license, the open-source license controls for that software.
Game balance, maps, ships, weapons, buildings, rankings, membership benefits, and other features may be added, removed, reset, rebalanced, or changed. We do not guarantee that any particular strategy, unit, feature, rank, statistic, or progression state will remain available.
Unless we expressly state otherwise, game resources, rankings, unlocks, cosmetic items, and other virtual features have no cash value, are not legal tender, cannot be redeemed for money, and do not create property ownership. Marauder's Sea is a strategy game and is not gambling.
You may not use the Service to:
Competitive tactics allowed by the game are not misconduct merely because another player dislikes them. Enforcement focuses on conduct outside the intended rules and mechanics.
The Service may allow usernames, messages, reports, profile information, or other material submitted by players ("User Content"). You retain any rights you hold in your User Content. You grant Flying V a worldwide, nonexclusive, royalty-free license to host, store, reproduce, display, moderate, and distribute that content only as reasonably necessary to operate, secure, promote, and improve the Service.
You represent that you have the necessary rights to submit your User Content. We may remove or restrict User Content that violates these Terms, but we are not obligated to monitor every communication.
Player display names, player identifiers, match history, rankings, statistics, achievements, and similar competitive information may be visible to other players or the public. Where useful for moderation and anti-impersonation, the Service may also display recent display names or an indication that an account has been restricted. The Privacy Policy will explain these disclosures in greater detail.
We may investigate suspected violations and issue warnings, mute communications, remove content, reverse improper game results, restrict features, suspend accounts, or permanently terminate access. Enforcement decisions may consider severity, repetition, evidence, risk to players, and attempts to evade prior action.
Restrictions may also be applied to related accounts when evidence reasonably indicates common ownership or control, coordinated abuse, or an attempt to evade enforcement. We may require a player to change a display name and may remove improperly obtained statistics, rankings, rewards, or match results.
The Service may use automated systems to screen display names, detect suspected cheating or abuse, support matchmaking, and calculate rankings. Automated signals may be reviewed together with reports, game records, and other evidence. You may request review of an account restriction by contacting help@maraudersea.com; an appeal does not guarantee reversal.
We may preserve and disclose relevant records when reasonably necessary to enforce these Terms, protect users or the Service, respond to legal process, or comply with law.
The Service may experience maintenance, outages, errors, attacks, data loss, or interruptions. We may modify, suspend, discontinue, reset, or restrict all or part of the Service. Where reasonably practicable, we will provide notice of material changes affecting paid memberships.
We do not promise uninterrupted availability, permanent preservation of rankings or match history, compatibility with every device, or continued support for any particular browser or feature.
The Service may rely on third-party hosting, authentication, payment processing, analytics, communications, or links. Third-party services are governed by their own terms and privacy practices. Flying V is not responsible for third-party products or services except to the extent required by law.
Our Privacy Policy explains what information we collect, why we use it, how it is shared, and the choices available to users. The Privacy Policy is incorporated into these Terms by reference. Do not publish the Service with account registration, analytics, payments, or online identifiers until an accurate Privacy Policy is available.
If you believe content available through the Service infringes your copyright, trademark, or other rights, send a detailed notice identifying the protected work, the allegedly infringing material, its location, your contact information, and a statement supporting your claim. We may remove material and terminate repeat infringers where appropriate.
Marauder's Sea is an independent modified version of OpenFront and is not affiliated with or endorsed by OpenFront Inc. The covered source code is made available under the GNU Affero General Public License, version 3, together with applicable additional terms. Nothing in these Terms restricts rights granted under that license.

FLYING V DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL BE FREE FROM HARMFUL CODE, CHEATING, DATA LOSS, OR THIRD-PARTY INTERFERENCE.
Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLYING V AND ITS OWNERS, CONTRIBUTORS, CONTRACTORS, SERVICE PROVIDERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST GOODWILL, SERVICE INTERRUPTION, OR SUBSTITUTE SERVICES ARISING FROM OR RELATED TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLYING V'S TOTAL LIABILITY ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FLYING V FOR THE SERVICE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100.
These limitations do not apply where liability cannot legally be excluded or limited.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Flying V and its owners, contractors, and representatives from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful conduct, your User Content, your material violation of these Terms, or your infringement of another person's rights. This obligation does not apply to the extent a claim results from Flying V's own unlawful conduct.
You may stop using the Service at any time and may cancel a membership as described above. We may suspend or terminate access for violations, legal or security risk, nonpayment, prolonged inactivity, discontinuation of the Service, or other legitimate operational reasons.
Upon termination, your permission to use the Service ends. Provisions concerning ownership, open-source rights, disclaimers, liability, indemnification, disputes, and other terms that logically should survive will remain effective.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Subject to any consumer rights that cannot be waived, the state and federal courts located in Polk County, Florida will have exclusive jurisdiction over disputes arising from these Terms or the Service, and you consent to their personal jurisdiction.
Before filing a lawsuit, you and Flying V agree to make a good-faith attempt to resolve the dispute informally by written notice and at least 30 days for a response. Either party may seek immediate relief when necessary to protect accounts, systems, intellectual property, personal safety, or other rights from imminent harm.
We may update these Terms as the Service, memberships, or law changes. We will post the revised Terms and update the effective date. For material changes, we will provide additional notice through the Service, email, or another reasonable method. Continued use after the effective date of revised Terms constitutes acceptance where permitted by law.
These Terms and incorporated policies constitute the entire agreement concerning the Service. If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; Flying V may assign them as part of a merger, reorganization, asset transfer, or change in control. Headings are provided for convenience and do not limit interpretation.
